Practice Area

Family Law. Clarity and strength through life's hardest transitions.

Compassionate, strategic representation in divorce, separation, parenting, support and property division across Ontario.

Overview

Family law disputes are unlike any other: the opposing party is someone you once trusted, the stakes include your children and your financial future, and emotion runs through every decision. You need counsel who brings calm, structure and strategy to a chaotic time.

Waliani Law represents spouses and parents in negotiation, mediation and litigation under Ontario's Family Law Act, the Divorce Act and the Children's Law Reform Act. We resolve matters out of court whenever possible — and litigate decisively when it is not.

Our promise is candour: realistic advice about outcomes, transparent fees and a strategy built around what actually matters to you and your children.

Common Legal Issues

  • You are considering separation and want to understand your rights first
  • You need a parenting schedule that works — and a former partner who follows it
  • Support is unpaid, or the payor's real income is being hidden
  • You've been served with a family court application
  • You want a separation agreement instead of a court battle
  • You are remarrying and want a marriage contract

How We Help

Settlement-First Approach

Court is expensive, slow and public. We pursue negotiated agreements and mediation first — preserving relationships and resources.

Children at the Centre

Parenting arrangements built around your children's best interests, stability and your ongoing role in their lives.

Financial Precision

Support and equalization turn on numbers. We build rigorous financial disclosure and work with valuators where needed.

Decisive Litigation

When the other side won't be reasonable, we move — motions, case conferences and trial advocacy that protect your position.

Results our clients talk about.

My separation was resolved through a negotiated agreement without ever setting foot in a courtroom. I always understood my options, the costs and the strategy. My kids and I are in a better place because of it.

Frequently Asked Questions

Answers, in plain language.

Married spouses equalize their net family property: each spouse calculates the growth in their net worth during the marriage, and the spouse with the higher growth pays half the difference to the other. The matrimonial home receives special treatment, and certain assets — like gifts and inheritances kept separate — may be excluded. Common-law partners are not covered by equalization and rely instead on trust claims.
